Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of Always Answering, an AI receptionist service operated by Fix IT Technologies ("we", "us", "our"). By using our service, you agree to comply with this AUP. Violations may result in suspension or termination of your account without refund.

1. Lawful Use

You agree to use the service only for lawful purposes and in accordance with all applicable federal, state, and local laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and state-level consumer protection laws.

2. Prohibited Activities

You may not use Always Answering to:

• Send unsolicited marketing calls or text messages (spam)
• Engage in robocalling, autodialing, or mass-broadcast operations
• Conduct any form of telemarketing without proper consent and DNC compliance
• Impersonate any person or entity, or misrepresent your affiliation
• Conduct fraudulent, deceptive, or misleading business practices
• Collect personal information from callers without clear disclosure
• Promote illegal goods or services (drugs, weapons, gambling without license, etc.)
• Engage in adult content, escort services, or sexually explicit activities
• Distribute malware, phishing attempts, or scam content
• Harass, threaten, defame, or abuse callers
• Violate intellectual property rights of others
• Resell, sublicense, or redistribute the service without written permission

3. Business Type Restrictions

Always Answering is intended for legitimate service-based small businesses such as roofing, plumbing, HVAC, dental, salon/spa, landscaping, and similar trades. We reserve the right to refuse service to businesses in industries with high regulatory or fraud risk, including but not limited to:

• Debt collection
• Payday loans and high-interest lending
• Cannabis or CBD sales
• Cryptocurrency trading or "investment" services
• Multi-level marketing (MLM)
• Adult entertainment

4. SMS Compliance

All SMS messages sent through the service must comply with carrier rules and TCPA. You agree that:

• SMS messages are sent only to callers who have provided their phone number during a call (implied consent)
• All messages include opt-out instructions ("Reply STOP to opt out")
• Opt-out requests are honored immediately
• You will not use the service to send promotional or marketing texts to numbers you obtained outside of this service

5. AI Agent Configuration

You are responsible for the content and instructions you provide to your AI agent through the dashboard, including business information, FAQs, and special instructions. You agree not to:

• Configure the agent to deceive callers or make false claims
• Instruct the agent to collect sensitive personal information (Social Security numbers, full credit card numbers, medical history)
• Use the agent to provide professional advice (legal, medical, financial) that requires licensure
• Configure the agent to engage in any activity prohibited by this AUP

6. System Abuse

You may not:

• Reverse engineer, decompile, or disassemble the service
• Use bots, scrapers, or automated tools to access the service or dashboard
• Attempt to gain unauthorized access to other accounts or our systems
• Overload, flood, or otherwise interfere with the service infrastructure
• Use the service in any way that could damage, disable, or impair our systems

7. Reporting Violations

If you become aware of any violation of this AUP, please report it immediately to [email protected].

8. Enforcement

We reserve the right to investigate suspected violations and take appropriate action, including:

• Issuing a warning
• Suspending your account temporarily
• Terminating your account without refund
• Releasing your assigned phone number
• Reporting illegal activity to law enforcement
• Pursuing legal action to recover damages

9. Changes to This Policy

We may update this AUP from time to time. Changes will be posted on this page with an updated revision date. Your continued use of the service constitutes acceptance of the updated policy.
