TCPA Compliance

Always Answering is committed to full compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and related federal and state regulations governing voice and SMS communications.
1. What is the TCPA?
The Telephone Consumer Protection Act (47 U.S.C. § 227) is a federal law that restricts telemarketing calls, the use of automated telephone equipment, and the sending of unsolicited text messages. Violations can result in fines of $500 to $1,500 per call or message.
2. How Always Answering Stays Compliant
- Inbound only: Our AI agent only responds to calls dialed by the customer. We do not initiate outbound calls.
- Implied consent for SMS: When a caller provides their phone number during a call (e.g. to book an appointment), they have given implied consent to receive a transactional SMS related to that interaction.
- Transactional only: SMS messages are limited to appointment confirmations, booking reminders, and follow-up texts directly related to the call. We do not send promotional or marketing texts.
- Opt-out support: Every SMS includes "Reply STOP to opt out." Opt-out requests are processed automatically and immediately by our SMS provider (Twilio).
- Opt-out persistence: Once a recipient opts out, we will not message them again from the same number, even if they call back later.
- Texting hours: Booking reminders are only sent between 8 AM and 9 PM in the recipient's local time zone, in compliance with TCPA quiet hours.
- A2P 10DLC registration: All phone numbers used by Always Answering are registered through Twilio's A2P 10DLC program, which requires carrier-level approval for business messaging.
- Call recording disclosure: The AI receptionist verbally announces "This call may be recorded for quality assurance" at the start of every call.
3. Customer Responsibilities
As a customer of Always Answering, you agree to:
- Use the service only for legitimate inbound call answering for your business
- Not configure your AI agent to make false claims, deceive callers, or impersonate other entities
- Not use phone numbers obtained through this service to send marketing messages outside the platform
- Honor any opt-out requests received from your customers
- Comply with all federal, state, and local laws including the TCPA, CAN-SPAM, and DNC regulations
4. SMS Message Types
The following SMS message types may be sent by your AI receptionist:
- Confirmation SMS: Sent immediately after a caller books an appointment, confirming the date, time, and details.
- Follow-up SMS: Sent after a call where no appointment was booked, thanking the caller for their interest. (Standard and Pro tiers only.)
- Booking reminder: Sent the day before a scheduled appointment as a reminder. (Standard and Pro tiers only.)
- Review request: Sent after a job is marked complete, requesting a review on Google or Facebook. (Pro tier only.)
All messages are tied to a specific caller interaction and are considered transactional or service messages under TCPA.
5. Opt-Out Process
Recipients can opt out of SMS messages at any time by:
- Replying STOP, UNSUBSCRIBE, QUIT, or END to any message
- Replying HELP for assistance
Opt-out is processed at the carrier level by Twilio. Once opted out, the recipient will no longer receive SMS messages from the assigned business number, even if they call again. To re-subscribe, the recipient can text START to the same number.
6. Call Recording and Privacy
All calls handled by Always Answering are recorded for quality assurance and to provide call summaries to the business owner. Callers are notified at the start of every call via the agent's greeting. Recordings are stored securely and are accessible only to the business owner through their dashboard. See our Privacy Policy for retention details.
7. Reporting Concerns
If you believe a customer of Always Answering is violating TCPA or sending you unwanted messages, please report it to:
